This notice is based on Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation, “GDPR”).

2. Which data do we process?

Proposal request form. The data entered in the form: name, company name, email address, telephone number (if provided), the subject of the enquiry and the content of the message.

Enquiries sent by email. The sender’s name and email address and the content of the message, including the contact details in the signature.

We receive the data directly from you. Please do not include special categories of personal data in your first enquiry, and do not send personal data about other people that are not needed for the enquiry.

3. Purpose and legal basis of processing

We use the data to reply to your enquiry, to prepare the proposal and to stay in contact with you in this context.

The legal basis of processing is:

  • Article 6(1)(b) GDPR, where processing is necessary in order to take steps at your request prior to entering into a contract;
  • Article 6(1)(f) GDPR, that is, the legitimate interest of the controller, where you contact us as the representative or contact person of a company. In this case the legitimate interest is replying to the enquiry and establishing business contact.

We do not use the data to send newsletters or for any other marketing purpose, and we do not carry out automated decision-making or profiling on them.

Providing the data is voluntary; without a name and an email address, however, we cannot reply.

4. How long do we keep the data?

We keep the data provided in the enquiry for the following period: if the enquiry leads to an engagement, for 5 years after the engagement ends; if no engagement is concluded, for 1 year from the enquiry.

If the enquiry leads to a contract, the processing of contract-related data is governed by the rules on performance of the contract and on statutory retention obligations; we inform you about this separately when the contract is concluded.

5. Who may see the data?

The data may be seen by those staff members and contracted partners of the controller who need them in order to reply to the enquiry.

We use the following service providers as processors:

  • hosting: GitHub, Inc. (GitHub Pages), 88 Colin P. Kelly Jr. Street, San Francisco, CA 94107, USA;
  • email: Google Workspace;
  • form handling: we do not use a separate form service; the form sends an email through your own email program, which we receive on Google Workspace.

If a processor processes personal data outside the European Economic Area, the transfer takes place under the conditions laid down in Chapter V of the GDPR.

We do not pass your enquiry on to any other third party. The independent law firm that handles legal matters is a separate controller; we transfer data to it only at your express request.

6. Cookies and audience measurement

The website does not place cookies on your device and does not currently use any audience measurement script.

The website is served by GitHub Pages. To deliver the pages and keep the service secure, the hosting provider may process technical log data (such as IP addresses); this is governed by GitHub’s privacy statement.

If we introduce audience measurement in the future, we will first state in this notice the method of measurement, the service provider and the legal basis of processing.

7. Your rights

Under the GDPR you may:

  • ask whether we process your personal data and request a copy of them (right of access);
  • request the rectification of inaccurate data;
  • request the erasure of the data if the processing no longer has a purpose or a legal basis;
  • request the restriction of processing;
  • object to processing based on legitimate interest;
  • request that data processed by automated means on the basis of pre-contractual steps be provided to you in a portable format.

You can send your request to info@consiliar.com. We reply without undue delay and at the latest within one month of receipt; under the GDPR this period may be extended by a further two months where necessary, in which case we will inform you.

8. Remedies

If you believe that we are not handling your data properly, please contact us first.

You may lodge a complaint with the Hungarian National Authority for Data Protection and Freedom of Information (Nemzeti Adatvédelmi és Információszabadság Hatóság, NAIH; 1055 Budapest, Falk Miksa utca 9–11.; www.naih.hu), and you may also bring the matter before a court. You may also bring the action before the regional court (törvényszék) of your place of residence or place of stay.
